Indiana Tax Amnesty 2026: Enrollment Deadline of September 9

The Indiana Department of Revenue's Tax Amnesty 2026 program is approaching its final enrollment date. Individuals and businesses with unresolved Indiana tax liabilities incurred prior to January 1, 2024 have until September 9, 2026 to enroll. Taxpayers who do so receive materially more favorable terms than those available under the Department's standard collection procedures.

Program Terms

Under Tax Amnesty 2026, the Indiana Department of Revenue will waive penalties, interest, and collection fees on qualifying liabilities predating January 1, 2024, provided the taxpayer enrolls before the deadline. On an aged balance, accrued penalties and interest can approach or exceed the amount of tax originally owed; accordingly, amnesty enrollment can result in a substantial reduction in the total amount due.

Qualifying taxpayers may satisfy their obligation through a lump-sum payment or through a structured payment plan extending through June 2027. It should be noted that enrollment, not full satisfaction of the liability, is the operative requirement for the September 9 deadline. A taxpayer who establishes a qualifying payment plan prior to the deadline secures the waiver of penalties and interest, notwithstanding that the underlying balance is repaid over a subsequent period.

Considerations for Businesses and Individuals

Following the close of the enrollment window, the Department's standard penalty and interest provisions will resume applicability to any unresolved liability. The relief currently available under this program will not be extended or renewed on the same terms. Taxpayers with an outstanding pre-2024 Indiana tax liability — whether arising from prior financial hardship, an unresolved dispute, or an administrative oversight — should regard this as a defined and non-recurring opportunity to resolve the matter under favorable conditions.

This is of particular relevance to businesses. Liabilities arising from withholding tax, sales tax, or other business tax obligations are eligible under the same pre-2024 threshold. Unresolved business tax liabilities carry independent collection exposure, including the potential for liens, garnishment of receivables, and complications in connection with future financing, sale, or ownership transition. Resolution under amnesty terms eliminates this exposure in advance of such events.

Recommended Course of Action

Given the proximity of the deadline, GCAAG advises the following course of action for clients with Indiana tax exposure predating January 1, 2024:

1.    Confirm whether any outstanding Indiana tax liability was incurred prior to January 1, 2024.

2.    Evaluate whether a lump-sum payment or a structured payment plan is appropriate, based on available liquidity and the size of the liability.

3.    Complete enrollment with the Indiana Department of Revenue on or before September 9, 2026.

GCAAG's tax planning and IRS representation practice is prepared to assist clients in confirming outstanding balances, evaluating available payment options, and completing enrollment prior to the deadline. Given the limited time remaining, prompt engagement is advisable.
